1. Core Definitions

  • The Company: Go Pay Monthly (Knexgen Ltd).

  • The Client: The entity or individual entering into an agreement for services.

  • The Project: Any website build, marketing campaign, or technical service provided.

  • Subscription: The recurring monthly payment agreement for website access, hosting, or marketing services.

  • Live Mode: The point at which the website or marketing campaign is published to the public.


2. Website Design & “Pay Monthly” Model

  • Service Structure: Our “Pay Monthly” websites are provided as a service. While you have full use of the site, the underlying design and custom code remain the property of the Company until a predefined “Buyout” or “Minimum Term” (as specified in your Order Confirmation) is met.

  • Deposits: All initial setup fees or deposits are non-refundable. This covers the “Initiation Phase” (Days 1–7) and the “Active Phase” of design.

  • Project Completion: We aim for rapid deployment. If the Client fails to provide necessary content (text/images) within 14 days, the Company reserves the right to begin the monthly billing cycle regardless of whether the site is “Live,” as resources have been allocated.

  • Support: All websites include 30 days of “Launch Support” post-deployment.


3. Web Hosting & Domain Management

  • Hosting Limits: Standard hosting is capped at 2GB of storage. We reserve the right to upgrade your plan or charge overage fees if your site exceeds this limit or consumes excessive server CPU/RAM.

  • Uptime & Liability: We utilize high-quality servers but do not guarantee 100% uptime. We are not liable for lost revenue due to technical downtime.

  • Domain Ownership: Domains registered by us on your behalf are your legal property. However, if a domain is provided “Free” as part of a package, it must remain hosted with us for a minimum of 60 days before it can be transferred.

  • Transfer Fees: A £12 admin fee applies to transfer a domain away from our management.


4. Search Engine Optimisation (SEO)

  • No Guarantee of Rank: SEO is subject to third-party algorithm changes (Google, Bing). We do not guarantee specific page-one rankings or “Number 1” spots.

  • Methodology: We use “White Hat” techniques. We are not responsible for ranking drops caused by previous “Black Hat” SEO work performed by other agencies.


5. Google PPC Ads & Management

  • Ad Spend: Unless explicitly stated, your monthly fee to Go Pay Monthly covers management only. The actual “Ad Spend” is paid directly to Google via your own linked billing method.

  • Account Access: We require administrative access to your Google Ads account to perform services.

  • Performance: While we optimize for conversions, we cannot guarantee a specific Return on Ad Spend (ROAS) as sales depend on the Client’s pricing, website offer, and market conditions.


6. Click Fraud Protection

  • Service Scope: We utilize automated software to detect and block malicious IP addresses and “bot” clicks on your PPC ads.

  • Limitations: While this significantly reduces wasted spend, no system can block 100% of fraudulent activity. We are not liable for any “missed” fraudulent clicks that result in charges from Google.


7. Payments, Late Fees & Cancellations

  • Billing Cycles: Payments are taken via Direct Debit or Standing Order on the anniversary of your signup.

  • Grace Period: We allow a 2-day grace period.

  • Suspension: Accounts 5 days overdue will be suspended (websites taken offline/ads paused).

  • Termination: Accounts 15 days overdue may be terminated. All data will be deleted, and the Company is not liable for the loss of files or SEO rankings resulting from this.

  • Late Fee: Overdue accounts incur a fee of £1.00 or 10% of the balance (whichever is greater).

  • Cancellation: We require 30 days’ written notice to cancel any monthly subscription.


8. Prohibited Content & Conduct

We do not host or market websites containing:

  • Illegal drugs, weapons, or pirated material.

  • Adult content, pornography, or escort services.

  • Hate speech, defamatory content, or “Spam” marketing scripts.

  • Zero Tolerance: Breach of these terms results in immediate account termination without refund.


9. Limitation of Liability

Go Pay Monthly shall not be held liable for any loss of profits, loss of data, or consequential damages arising from the use of our services. The maximum liability of the Company shall not exceed the amount paid by the Client for the service in the one month preceding the claim.


10. Legal Jurisdiction

This agreement is governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
